LIABILITY WAIVER FOR Music Together® SEA STARS
ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY. As a willing participant in classes with Music Together Sea Stars, my family and I agree to the following:
ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, COVID-19, RSV, Flu, etc), may exist in the community and present an inherent risk that cannot be eliminated. I acknowledge that, Music Together Sea Stars is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes between people in our classes (including our teachers and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children, including all adults, when arriving to, participating in, or departing from class. I understand and agree that as a registered family with Music Together Sea Stars I am accepting and voluntarily assuming the risk that my child or I may be exposed and become ill as a result of COVID-19, RSV, and other diseases.
WAIVER OF LIABILITY: I, on behalf of myself and my children, hereby voluntarily release, forever discharge, and covenant not to sue Music Together Sea Stars or Sea Star Kids Foundation and its owners, managers, contractors, members, employees, agents, and volunteers, or the location owner (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to COVID-19, RSV, or any other accident that may cause harm. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties.
I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES WITH SEA STAR MUSIC TOGETHER, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.
Health Assessment Before you leave home: Please do a quick health assessment and stay home if you or anyone living in your home is showing any of these symptoms: fever, cough, shortness of breath, difficulty breathing, other respiratory symptoms, or any two of these symptoms: chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. Please stay home and contact us at [email protected] if you or anyone you've been in close contact with has been exposed to COVID-19 or any other communicable disease. If there is a known in-class exposure in the class we will contact the Mendocino County Health Department and follow their current guidelines.
GENERAL TERMS AND CONDITIONS FOR MUSIC TOGETHER
For Music Together, there is a maximum 12 families per class. Babies under 8 months are free, however, all children attending class must be enrolled. Please choose the sibling under 8 months option when enrolling your baby under 8 months.
Make-up classes for Music Together: For your convenience, we offer 2 makeup classes per Music Together session. Makeup classes are scheduled on a first come, first served, honor system basis, and must be used within the current session. Make-up classes can be scheduled using our online make-up scheduler. Please be considerate of your fellow students: If you cannot attend a scheduled makeup class, please cancel as soon as possible so someone else can use that spot. We are not currently able to provide makeups for other creative arts classes, but contact [email protected] if you have to miss a class.
Refund Policy: Once confirmed in a Music Together class, a $25 processing fee will be deducted for withdrawals if cancelled before the session begins. No refunds are given after the current session begins. However, a credit towards a future session can be given in full before the session starts or a partial credit after the session begins. Opened Music Together materials cannot be refunded/returned and must be purchased at a cost of $50. All other creative arts classes will incur a $15 processing fee for withdrawals if cancelled before the session begins. No refunds are given after a session begins.
Safety: Parents, legal guardians of minor students and adult students waive the right to any legal action for any injury sustained during class resulting from normal class activity or any other activity conducted by families before, during, or after class time.
